Terms & Conditions

  • Definitions
    • Commencement is the date of installation of furniture to the property
    • Furniture is any and all items as per quote & delivery inventory
    • Styling means the concept, implementation, co-ordination and installation of furniture.
    • Hire period is the period of time from commencement for the agreed period of time as quoted with the exception of any extensions.
    • Agreement is the agreement between iDRESS interiors and the client including; quotation, acceptance, inventory list and these terms and conditions.  
    • Invoice is the invoice rendered to the client from iDRESS interiors containing the amount payable.
    • Owner is iDRESS interiors providing styling and hire of furniture to the client
    • Price is the amount detailed in the invoice rendered to the client from the owner
    • Client is the person, business or company which is engaging iDRESS interiors for styling services and hire of furniture
    • Property is the location at which the furniture is to be hired.
  • Quotation & Acceptance

After consultation with the client, iDRESS interiors will provide a quote detailing the recommended styling for the property and the price.  Written acceptance of the quotation is required by iDRESS interiors from the client or their authorised representative either via email or hard copy.  A deposit of 25% of the agreed fee is required to be paid in full to iDRESS interiors.

  • Hire Terms

The furniture will be hired for the amount of time stated on the quotation. The parties may agree to an extension of the original hire term by written and signed authorisation.  No refunds or discounts will be offered if the property sells within the agreed hire period.  iDRESS interiors reserves the right to collect hired items from the property if it is sold before the hire period expires If the client fails to fulfil or abide by these terms and conditions, iDRESS interiors may terminate the agreement without notice and remove all furnishing and accessories. 

  • Authority

The client will grant iDRESS interiors permission to enter and remain on the property for the purpose of delivery and installation of furniture.  The client shall make all reasonable attempts to make the property available to iDRESS interiors at any time during the hire period.

  • Advice
    • Cosmetic – all recommendations are cosmetic in nature. 
    • Guarantee – iDRESS interiors will use all practical undertakings to present the property in the best possible manner to the market. iDRESS interiors offers no guarantee regarding the sale of the property and is not liable for the final outcome of the sale of the property.
    • Good Faith – any advice and recommendation provided by iDRESS interiors to the client is done so in good faith.  
  • Payment

Subject to any terms agreed between iDRESS interiors and the Client, the terms of payment are as follows:  Payment is due in full, less deposit paid, no later than 48 hours prior to installation of furniture. Payment can be made via EFT or cheques are also accepted.  Extension costs are as quoted and weekly rates apply thereafter until you notify iDRESS interiors in writing that the property is sold or you wish to cease hire.

  • Cancellation

If the client wishes to cancel the agreement, written notification 4 days prior to installation is required. iDRESS interiors may charge a cancellation fee of up to 100% of the deposit at their discretion.

  • Default

Payment for extension rental charges are due 7 days from the date of the invoice.  iDRESS interiors reserve the right to charge 10% administration fees to any invoice that remains outstanding for 21 days or more.  In the event that the clients payment is dishonoured for any reason the client shall be liable for any dishonour fees incurred by iDRESS interiors.

If the client defaults in payment of any invoice when due, the client shall indemnify iDRESS interiors from and against all costs and disbursements incurred by iDRESS interiors in pursuing the debt including legal costs and collection agency costs.  

If at any time the client is in breach of any obligation (including those relating to payment), iDRESS interiors may terminate the hire agreement and will not be liable to the client for any loss or damage the client suffers because iDRESS interiors has exercised its rights under this clause.

  • Delivery & Installation

As per the agreement iDRESS interiors will install furniture and accessories in the property for display purposes only.  None of the furniture is to be used in any way.  The furniture must not be moved or removed from the property.  Wall hooks used to hang artwork or mirrors will remain in place once the property is sold or the hire period ceases.  While iDRESS interiors use due care in providing its services and installation of furniture, the client indemnifies iDRESS interiors in respect to and loss or damages arising from furniture installation and placement, including impressions in carpets.

  • Owner’s Obligations
    • iDRESS interiors will provide styling advice and furniture for the duration of the hire period as per the agreement.  
    • Furniture provided will be clean and in working order. 
  • Client’s Obligations
    • The client agrees not to remove or allow any other person to remove the furniture from the property noted in the agreement. 
    • The client agrees to keep the furniture in good order and stored safely and securely, protected from loss, theft or damage.   Any damage or loss to furniture at the property for the duration of the hire period is the responsibility of the client.  Accordingly the client is requested to take out insurance to cover all liabilities incurred as a result of use of the furniture.  
    • The client is required to notify iDRESS interiors of any accidental damage or loss to the furniture within 24 hours and the client will be liable to pay any replacement or repair costs deemed necessary by iDRESS interiors. 
    • The client agrees not to tamper with, modify, alter or repair the goods without the owners written consent.
    • The client agrees to provide iDRESS interiors reasonable access to the property for the purpose of delivery, installation, inspection, repair and collection through out the duration of the hire period.
  • Third Party Services

iDRESS interiors may recommend third party suppliers, but will not engage any other supplier or business without written consent of the client.  The client will be responsible for any invoices or charges issued by third party businesses in respect to the property.  iDRESS interiors provides no warranties and accepts no responsibility for the goods or services delivered by any other business they have recommended.

  • Title

iDRESS interiors always retains the title to the furniture.  The client holds the furniture in bailee for the term of the hire period.

If an agreement has been made for any or all of the goods to be sold to the client, ownership of the goods will remain with iDRESS interiors until they are paid for in full.

  • Termination

Either party may terminate this agreement by written notice if either party is in breach of the terms of the agreement and fails to rectify the breach within 7 days.  The owner reserves the right to terminate the agreement within 24 hours for serious breaches of the agreement.

If the owner terminates the agreement, the client consents to the owner entering the property for the purpose of recovering the furniture.  The client indemnifies the owner against any costs or damages arising from iDRESS interiors exercising its rights under this clause.

  • Indemnity & Limit of Liability
    • iDRESS interiors will not be liable for the consequences of any circumstance reasonably beyond iDRESS interiors control which affects its obligations under this Agreement.
    • All guarantees, terms, conditions, warranties, undertakings or representations express or implied in any way relating to this Agreement are excluded to the maximum extent permitted by law. Notwithstanding this, nothing in this Agreement restricts or modifies any right or remedy including any guarantee imposed or implied under the Australian Consumer Law (if applicable) which contains guarantees to protect consumers of certain goods and services.
    • iDRESS interiors liability for breach is limited to (at their sole discretion) the repair or replacement of the furniture or the supply of substitute furniture.
    • iDRESS interiors is not liable for any consequential, indirect loss or damage, loss of profits, loss of business, business interruption, costs or amounts that the client is  are liable for arising out of any loss suffered by third parties under or relating to this Agreement.
    • The client indemnifies iDRESS interiors against all liability, claims, damage, loss, costs and expenses (including, without limitation, legal fees, costs and disbursements on a full indemnity basis, whether incurred against or by Us in respect of: personal injury, damage to tangible property or a claim by a third party.
  • Photography

The client agrees to allow iDRESS interiors to photograph areas of the styled property before and after services for the purpose of both printed and online marketing.

The client gives permission for iDRESS interiors to have access to professional photographs of the property and agrees to their use in iDRESS interiors portfolio and marketingImages used by iDRESS interiors will credited to the photographer if the photographers details are provided.

  • Personal Information & Privacy
  • Confidential Information means all confidential, non-public or proprietary information of one party regardless of how it is stored, delivered, provided to or learnt by the other party in relation to this Agreement, but does not include excluded information such as information that is or becomes available in the public domain other than through breach of this Agreement. Confidential Information includes all pricing and related terms pertaining to the provision of Services under this Agreement.
  • Neither party may disclose any Confidential Information to any person without the other party’s written consent, except to representatives requiring the information for the purposes of, and in accordance with, this Agreement, or if either party is required to do so by law.
  • This clause survives termination of this Agreement.
